Promotion of Access to Information Act

1. Introduction

This manual has been compiled in accordance with the requirements of the Promotion of Access to Information Act, 2 of 2000 ("PAIA"), as amended by the Protection of Personal Information Act, 4 of 2013 ("POPIA"). The purpose of this manual is to assist persons in exercising their right to access information held by CyberJo (Pty) Ltd, subject to the procedural and substantive requirements of PAIA.

The following is a list of South African legislation that is applicable to the records held by CyberJo (Pty) Ltd. This list is not exhaustive.

5. Categories of Records Held by CyberJo (Pty) Ltd (Section 51(1)(e))

Access to these records is subject to the provisions of PAIA.

5.1. Corporate and Secretarial Records:

  • Minutes of director's meetings
  • Records relating to the appointment of directors, auditors and public officers
  • Share register

5.2. Financial Records:

  • Annual financial records
  • Tax returns
  • Accounting records
  • Banking records
  • Invoices and payment records
  • Internal and external audit reports

5.3. Human Resources Records:

  • Employee personal information and employment contracts
  • Employment equity records
  • Staff policies and procedures
  • Training records and leave records
  • Remuneration and benefits records

5.4. Customer and Client Records:

  • Customer contact information
  • Service agreements and contracts
  • Communication records

5.5. Information Technology Records:

  • Website and system documentation
  • Security policies and incident reports
  • Backup and disaster recovery plans

5.6. Legal Records:

  • Documentation pertaining to litigation or arbitration
  • General agreements
  • Licences, permits, and authorisations

6. Access Request Procedure (Section 51(1)(e))

To request access to a record, you must use the prescribed PAIA Form 2, which is available on the Information Regulator's website. The request must be submitted to the Information Officer. It is important to note that a request for access to a record is subject to certain limitations if the record falls within a category specified within Chapter 4 of PAIA.

7. Fees (Section 51(1)(f))

A fee may be charged for a request for access to a record. The fees are determined by the Minister of Justice and Correctional Services and are subject to change.

Request Fee: A standard fee for processing the request (currently R50.00, but is subject to change) may be required for requests made on behalf of a third party. This fee is not applicable to a personal requester.

Access Fee: This fee is for the reproduction and time spent searching and preparing the record. The current prescribed fees are:

  • For every photocopy of an A4-size page or part thereof: R1.10
  • For every printed copy of an A4-size page or part thereof: R0.75
  • For a copy on a compact disk: R70.00
  • For a transcription of an audio record (per A4-size page): R20.00
  • For a copy of an audio record: R30.00
  • To search for the record (per hour or part thereof): R30.00

8. Grounds for Refusal of Access to Records

Access may be refused on various grounds as outlined in PAIA, including but not limited to:

  • Protecting the privacy of a third party.
  • Protecting the commercial information or trade secrets of a third party or CyberJo (Pty) Ltd.
  • Protecting the safety of individuals and property.
  • Protecting legal and commercial interests.
  • The request is **frivolous or vexatious** or is made with the intention to harass the company.
  • Compliance with the request would result in an **unreasonable and substantial diversion of resources** of the company.

9. Remedies and Right of Appeal

If a request is refused, the requester has the right to lodge a complaint with the Information Regulator within 180 days of the refusal notice.

10. Availability and Updating of this Manual

This manual is made available in terms of PAIA and is effective from the date of publication. It will be reviewed and updated on a regular basis, as required.
